COD, Glen Ellyn agree to deal — for now
For now, College of DuPage and the village of Glen Ellyn have put their differences aside, and the college will be able to occupy four new or renovated buildings on Monday.But the long-running dispute over who has the authority over building matters on the 273-acre campus remains unsettled.Lawyers from both sides announced during a court hearing Wednesday that final village building inspections would take place Friday, after which certificates of occupancy would be issued.The buildings #8212; the Homeland Security Center, Culinary Hospitality Center, Berg Instructional Center and Student Services Center #8212; would be approved for occupancy Monday, exactly two weeks before classes are scheduled to begin on campus.But unresolved is the matter of who has jurisdiction of the campus. College officials have maintained that the school is not subject to local building codes, and that the school#146;s peer review inspection process goes above and beyond what the village would require. The village has sought written assurances from the college#146;s architects and engineers in the form of certificates of compliance to verify the buildings comply with local codes.Last month, both sides agreed to work together to resolve ongoing issues, while the village agreed to delay seeking a restraining order that would have prevented occupancy of the buildings.On Wednesday, the village agreed to withdraw its request for the restraining order.Judge Terence M. Sheen praised attorneys for working together the past two weeks to resolve their dispute over building inspections.#147;Good work,#148; Sheen said. #147;You guys have really guided your clients well.#148;But the larger question of jurisdiction awaits legal briefs to be filed by both sides in the next month or two, and an initial hearing could take place in late October.
