Cary police arrest three after pellet gun attack on Chicago man
Three people face felony charges after attacking a man with a pellet gun for selling them a batch of fake marijuana, Cary police officials said.
Nicholas Ciway, 20, and David Faulkner, 23, both of the first block of Main Street, along with a 17-year-old boy from Crystal Lake, face charges of aggravated robbery and mob action after the incident in downtown Cary on June 19, Cary Detective Jason Williamson said.
Ciway also picked up a charge of unlawful use of a weapon, while Faulkner was also charged with marijuana possession with intent to deliver, Williamson said.
Williamson said a 31-year-old man from Chicago and a 19-year-old man from Lake in the Hills met up with the three at about 10:30 p.m. June 19 for a marijuana deal in the 100 block of First Street in Cary.
However, the pair sold the three a look-alike substance in an attempt to rob them, Williamson said.
The suspects, after seeing the look-alike substance, called the two men back and arranged another deal to purchase more marijuana, Williamson said.
"At that time, the suspects conspired to rob the victims using Air Soft guns fashioned to look like real pistols," Williamson said.
Air Soft guns are fire small, plastic projectiles hard enough to hurt someone but not fast enough to pierce the skin.
At the second drug deal at about 11 p.m., Ciway pointed the pellet gun at the Chicago man and Lake in the Hills teen, and robbed them of about $100 and a watch, Williamson said.
After the two men were released, Williamson said, they realized the guns were not real. This prompted the 31-year-old to chase the trio back toward their apartment complex, Williamson said.
That led to a fight in the in the parking lot of the apartment complex, Williamson said, where the Chicago man was shot in the chest and arm with a pellet gun.
At that time, a 19-year-old from the complex walked outside and intervened in the fight, trying to stop it. She was injured in the scuffle and called police, Williamson said.
Everyone was taken into custody, but as of Wednesday morning only Ciway, Faulkner and the juvenile have been charged, Williamson said.
He said a search warrant was obtained later for the apartment where Ciway and Faulkner lived, and evidence of marijuana was discovered, along with several pellet guns.
Ciway and Faulkner remain in custody, Williamson said. Ciway's bond has been set at $90,000, while Faulkner's and the 17-year-old's has been set at $75,000.
He said the investigation continues and additional charges could be filed.
