Cozen O'Connor Attorneys Doyle, Guon, and Roberts Author Chapters in Business Bankruptcy Practice Handbook
Chicago attorneys David Doyle, Allen Guon and Peter Roberts, all members of Cozen O'Connor's Bankruptcy, Insolvency & Restructuring Practice, have each authored a chapter in the 2022 edition of Business Bankruptcy Practice.
Published by the Illinois Institute of Continuing Education, this annual handbook serves as a comprehensive guide to business bankruptcy, including such topics as the consequences of bankruptcy and out-of-court alternatives, the trustee's responsibilities and avoiding powers in business bankruptcies, involuntary bankruptcy, and Illinois common-law assignments for the benefit of creditors. It also includes a chapter on the new Small Business Reorganization Act of 2019.
In Chapter 6 of Business Bankruptcy Practice, "Advising Business Debtors: Alternatives to Bankruptcy," Doyle explores strategic alternatives available to a distressed company outside formal bankruptcy proceedings. He covers the advantages and disadvantages of workout alternatives while analyzing shutdown alternatives.
In Chapter 10, "Representing the Chapter 11 Debtor," Guon provides an overview and introduction to chapter 11 from the point of view of the debtor and debtor's counsel. Guon points out the first steps and goals for those filing a chapter 11 case and explains the process to achieve the best outcome.
In Chapter 18, "Asset Sales Under the Bankruptcy Code," Roberts gives insight on the Bankruptcy Code ยง 363 process and discusses fundamental asset sale concepts. In this chapter, he also articulates the relevant standards governing the sale of assets under the Bankruptcy Code.
In his practice, Doyle advises businesses of all sizes on winding down and restructuring their debts. He also represents creditors, purchasers of distressed assets, and defendants in fraudulent transfer and preference actions. Doyle recently served a two-year term on the Bankruptcy Court Liaison Committee for the Northern District of Illinois.
Guon advises debtors, creditors, purchasers, lenders, and other parties in interest in chapter 11 reorganizations, chapter 7 liquidations, and out-of-court workouts. He focuses his practice on the representation of debtors, court-appointed fiduciaries, and federal and state court receivers, as well as assignees in out-of-court liquidations.
Roberts represents clients in all matters of commercial insolvency, including bankruptcies, workouts, receiverships, assignments for the benefit of creditors, UCC Article 9 sales, and related litigation. He develops workout strategies for debtors and creditors, formulates and executes plans of reorganization, navigates asset sales in distressed situations, and litigates cases in state and federal courts.
