Elburn man admits to sex with 14-year-old girl, gets probation
A registered sex offender from Elburn pleaded guilty Wednesday to allegations he had sex with a 14-year-old Cary girl about the same time in 2007 he was accused of molesting another teen.
Sean A. Lewis, 21, of the 400 block of East Willow Street, admitted to a misdemeanor charge of criminal sexual abuse stemming from the incident about Jan. 1, 2007, in which he was accused of sexual contact with an underage girl.
In return for the guilty plea, McHenry County prosecutors dismissed a felony charge of criminal sexual assault claiming Lewis, who was 17 at the time, forced the girl into sex. The charge he admitted to does not allege force was used.
Under the plea deal, Lewis, formerly of Cary, was sentenced to two years probation, fined $1,000 and ordered to perform 100 hours of community service.
The agreement comes about 10 months after Lewis pleaded guilty to a previous misdemeanor charge of criminal sexual abuse stemming from allegations made by another 14-year-old Cary girl. The girl told authorities Lewis threatened her with a knife and raped her in January 2007, then told her he would harm her if she told anyone about it.
He initially was charged with aggravated criminal sexual assault and aggravated criminal sexual abuse, both felonies. But prosecutors reduced the charges as part of a plea deal made necessary, they said, because the victim moved out of state and refused to return and testify.
In that case Lewis was sentenced to two years probation, a 100-day suspended jail sentence and 100 hours of community service and was ordered to register as a sex offender.
