Restaurant settles suit in prosecutor's fatality
A lawsuit resulting from a fatal crash that killed a DuPage County prosecutor was settled Wednesday, attorneys said.
The case against an Oak Brook restaurant was settled for an undisclosed amount, said Lubinski's attorney, Dennis H. Stefanowicz.
Radostits, who died in the Winfield collision, had been drinking at lunch earlier, and officials said her blood-alcohol content was more than three times the legal limit.
In June, Lubinski sued the Kona Grill where Radostits, 46, and co-workers had dined, alleging the restaurant's staff over-served her.
Kona Grill's attorneys did not return calls Wednesday nor did officials with the restaurant.
Stefanowicz also indicted another lawsuit could be waiting in the wings against the county.
Lubinski, a single mother from West Chicago, has undergone two surgeries after being hit.
"She's getting a little better," Stefanowicz said. "She can walk around with crutches although she's not able to walk on her own. She's not pain-free but she has been able to return to work on a limited basis."
