Former assistant to District 53 superintendent sues for overtime wages

A former administrative assistant has filed a federal lawsuit against Butler Elementary District 53 in Oak Brook seeking unpaid overtime wages.

According to the suit, Vickie Galvin, of Oakbrook Terrace, worked as an administrative assistant to outgoing Superintendent Heidi Wennstrom from November 2014 to May 13.

"From the beginning of her employment through approximately December 2018, (the) defendant paid Galvin a fixed salary that did not fluctuate based upon her actual hours worked," the suit states. "During the three years preceding the filing of this complaint, Galvin routinely worked in excess of 40 hours per workweek."

The suit alleges the district violated the Fair Labor Standards Act by not paying Galvin the overtime rate of 1½ times her regular rate of pay.

Galvin is seeking back-pay for all overtime hours she worked, plus interest and attorneys fees.

The suit does not specify how many hours of overtime pay Galvin believes she is entitled to, nor does it specify her regular rate of pay.

Neither Galvin's attorney, Madeline Engel, or Wennstrom immediately returned calls seeking comment Thursday.
