Defense unsuccessful in getting trial delay in Libertyville slaying

An attorney was unsuccessful in delaying the trial date for a Round Lake Beach man accused of gunning down a Libertyville man he saw as a romantic rival.

Kenneth Seplak, 39, is due to go to trial April 29 on three counts of first-degree murder for the slaying of David E. Gorski on Milwaukee Avenue in Libertyville.

Defense attorney Steven McCollum tried Friday to push the trial back to May in order to obtain an expert on GPS coordinates.

Judge Mark Levitt balked at the delay because the case is more than two years old. Levitt said they would take the case "day-by-day" and ordered McCollum and prosecutors to return to court April 22 to see if final issues are cleared up and both sides will be ready for trial.

Gorski, 30, was found shot to death behind the wheel of his car after he attended a movie Dec. 23, 2016, with a Wauconda woman who Seplak previously had been accused of stalking, authorities said.

Authorities said Gorski and the woman started dating shortly before the night he was killed, and took separate cars to the Vernon Hills movie theater.

Prosecutors said GPS records from Seplak's mobile device showed he was at the Vernon Hills theater at the same time as Gorski and the Wauconda woman. The GPS also shows Seplak's vehicle was near the location where Gorski was found shot to death, authorities said.

Seplak, of the 1400 block of North Lake Shore Drive, is free on $300,000 bond, but remains on 24-hour curfew. He is required to wear a GPS monitoring device at all times, not allowed to possess guns or ammunition and is not allowed to have any contact with Gorski's family.
