Shouldn't get in car with drunken driver

After reading the article about a passenger suing two bars claiming the driver of the car in which she was riding was allowed to leave in a highly intoxicated condition and the servers should have known she was unfit to drive, I must ask why did Ms. Mendez get in the car? Shouldn't she have known that driver was intoxicated? Where was the common sense here and why is it always someone else's fault? We all must take responsibility for our own actions.
