Former nursing assistant guilty of kissing patient

A former certified nursing assistant was found guilty Tuesday of repeatedly kissing a disabled woman for whom he was supposed to care for at the DuPage Convalescent Center in Wheaton.

Tyrone V. Odilao faces either probation or up to five years in prison when he is sentenced. He did not have a prior criminal record.

DuPage Circuit Judge Perry Thompson found the 62-year-old Hanover Park man guilty of aggravated battery, but he acquitted Odilao of a similar felony alleging he abused the long-term health-care facility resident.

The quadriplegic woman testified Tuesday that Odilao repeatedly kissed her July 24, 2007, while giving her a shower and then again after he had dressed and put her into bed. She was 27 at the time and suffers from cerebral palsy.

"She was unable to move or resist him because of her condition," prosecutor Brian Perkins said. "She was very brave to come forward."

The woman said Odilao kissed her again that next day and told her not to tell anyone. Police became involved after her roommate, who became suspicious after seeing Odilao whispering to the woman, encouraged her to report what had happened.

Odilao is free on bond. He is due in court again Dec. 1, but likely won't be sentenced until early next year.
