St. Charles Halloween party-crasher convicted of resisting arrest

A West Chicago man accused of trespassing at a St. Charles apartment and choking a police officer on Halloween pleaded guilty to a lesser charge Thursday and was sentenced to probation.

Francisco Felix-Moreno, 27, pleaded guilty to resisting arrest in exchange for 18 months of probation, and about $700 in fines and costs. Kane County Judge James C. Hallock approved the plea deal.

Felix-Moreno was arrested around 6 p.m. Oct. 31 after he wandered uninvited into the living room of a family he did not know on the 1600 block of Indiana Street, police have said. After inexplicably standing in the apartment for several minutes without speaking, Felix-Moreno was lured out the door with a beer by one of the residents, according to police. Outside, he grabbed a responding officer by the throat and choked him, causing minor injuries.

Felix-Moreno could have faced up to seven years in prison if convicted of aggravated battery to a police officer, but the Class 2 felony was dropped in the plea deal. A Class 4 felony charge of criminal trespass also was dismissed.

Hallock also sentenced Felix-Moreno to 94 days in jail, with credit for 47 days already served since his arrest. Because he must serve only half the term, he was to be released immediately.
