Elburn youth baseball league sued

The family of an Elburn boy who was injured when he was hit by a baseball bat last year has filed a negligence lawsuit against a local youth baseball league.

The suit filed by Daryl and Wendy Kemp in Kane County Circuit Court last week claims the nonprofit Elburn Baseball and Softball organization failed to properly supervise an April 21, 2008, practice at which their 11-year-old son was struck in the hand by another player swinging a bat.

The family is asking for more than $50,000 in damages as well as court costs and medical expenses. The suit says the boy suffered permanent injuries, scarring and disfigurement.

"He's actually still in the process of recovering," the family's attorney, Daniel J. Kordik, said Tuesday without elaborating on the injuries. "He's still in the process of healing."

Elburn Baseball and Softball is run entirely by volunteers and is not affiliated with any park district, according to its Web site. A representative could not immediately be reached for comment.

The case goes to Judge Stephen Sullivan July 6.
