Oswego man on pretrial release facing new felony charges after woman punched in Wheaton

An Oswego man who was free on pretrial release on previous aggravated battery charges is facing additional felony charges after authorities say he punched a woman in the face and resisted arrest in Wheaton.

Marvin Carter, 48, has been charged with two felony counts of aggravated battery in a public place, two felony counts of resisting a police officer and one felony count of aggravated assault of an officer, as well as a misdemeanor battery charge.

According to a news release from the DuPage County state’s attorney’s office, Wheaton police responded just after 5:30 p.m. on July 11 to the report of an assault in the 700 block of West Liberty Drive near the entrance of the Illinois Prairie Path.

Prosecutors say a woman was seated on a bench near the entrance of the Prairie Path when Carter approached her. According to authorities, Carter stood directly in front of the victim, and when she stood up, he punched her in the head and neck with his fist, knocking her to the ground.

Authorities say Carter then kicked the victim’s property, which had scattered after she fell to the ground, and walked away.

Police officers located Carter and took him into custody after a brief struggle.

Prosecutors said Carter was awaiting trial on a previous non-detainable aggravated battery charge when the most recent battery took place.

While the new charges against Carter are also non-detainable, officials said his release was revoked after he refused to appear in court. He will remain at the DuPage County jail to await trial.

Carter’s next court appearance is scheduled for Aug. 2.
