Report: Aurora shooting victim's family files wrongful-death lawsuit

The family of a man killed in a mass shooting in Aurora last month has filed a wrongful-death lawsuit against the Illinois State Police, the Chicago Tribune is reporting.

The newspaper reported Wednesday that the lawsuit was filed by the family of Vicente Juarez, a forklift operator who was killed along with four others when a gunman opened fire at Henry Pratt Co. on Feb. 15. The gunman, who was a felon, also was killed.

According to the Tribune, an attorney for Juarez's family said Illinois State Police should have confiscated the gun after learning of an omission in the shooter's background check that should have prevented him from possessing it.

Illinois State Police have declined to comment on the lawsuit.

Shooting survivor Timothy Williams, a Pratt employee, filed a lawsuit against the state police earlier this month. He is seeking $2 million, claiming pain, suffering, disability and lost earnings. According to the lawsuit, he was shot three times and still has two bullets lodged in his back.
