Dunkirk judge guilty of shoving nephew police chief resigns

DUNKIRK, Ind. (AP) - An eastern Indiana city judge has resigned after receiving probation for shoving a police chief who's also his nephew.

The (Muncie) Star Press reports (http://tspne.ws/2qo5QNi ) the Indiana Supreme Court announced the resignation Friday of Dunkirk City Judge Tommy Phillips II. He had served on the bench since October 2000.

The 62-year-old Phillips received a one-year suspended sentence last month after pleading guilty to battery against a public safety official. He was accused of shoving Dunkirk's police chief who's also the judge's nephew during a disagreement last August.

After the battery charge was filed in September, the Supreme Court suspended Phillips. The Indiana Judicial Qualifications Commission this month filed a misconduct charge against him.

Under the terms of the judicial disciplinary action, Phillips cannot serve as a judge in the future.
