Maybe we need fewer justices
The U.S. Constitution established the Supreme Court in 1789 but the number of justices on the court is determined by Congress. Although the number has been nine for a long time, the original number was set as six. It might be simpler for Congress to change the number from nine to eight (or seven if another current justice leaves) than to argue over who should or shouldn't appoint Scalia's successor.
