Attendees Receive Updates at Home Healthcare Seminar
More than 150 professionals allied with the home healthcare businesses packed a room at the Donald E. Stephens Convention Center in Rosemont on September 25th to hear leading speakers discuss legal and regulatory aspects of the growing industry.
Kerry Lavelle, founding partner of Lavelle Law, Ltd in Palatine served as moderator for the event that the firm hosted. Lavelle Law, Ltd has operated a Home Healthcare Practice Group for over a decade. Among the presenters was Lavelle Law partner Ted McGinn, a leading practitioner in this specific area of law.
McGinn informed guests of the need for well-designed contracts in business transactions for home healthcare providers. His presentation touched on a variety of topics including marketing agreements, anti-kick back provisions, and personal guarantees. “I think guests left with a solid understanding of importance of these documents and the critical role they play in protecting their home health business,” McGinn said.
Aida Trinidad a member of the Illinois Department of Public Health Home Health, Home Services and Home Nursing Advisory Board provided a detailed look at the requirements and process associated with a standard survey of a home health company. State and Federal Regulatory Compliance was a central theme of her talk as she outlined the various triggers that would qualify a company for a partial or extended survey.
Matthew Sheahin, partner at Lavelle Law, Ltd., discussed shareholder agreements, including litigating majority shareholders for the oppression of minority shareholders. Not only did his presentation include a thorough examination of the qualifications of an oppressed minority shareholder, he described various remedies and proactive strategies to protect against shareholder oppression.
Leigh Roadman, principal at Martin, Brown, Sullivan, Roadman & Hartnett, Ltd., reviewed Medicare fraud as it relates to home healthcare agencies. His analysis of various initiatives and court cases provided guests with an in depth perspective of the punishments associated with various types of fraud common in the industry.
