Palatine man arrested on DUI charges for 3rd time

Schaumburg police said they charged a 30-year-old Palatine man currently on probation for assault and domestic battery with aggravated DUI after stopping him early Friday for driving 20 mph over the speed limit.

This marks the third DUI arrest for Noe Martinez-Tovar, of the 1800 block of Green Lane. His bail was set Friday at $80,000 by Cook County Judge Jill Cerone-Marisie.

A witness reported a car traveling west on Higgins Road at a high rate of speed at 1:24 a.m. Friday, said Lesley Gool, assistant state’s attorney. The officer stopped Martinez-Tovar, who the officer determined was driving 65 mph in a 45 mph zone, authorities said.

The defendant had no driver’s license and bloodshot, glassy eyes, authorities said. Martinez-Tovar, who registered a blood-alcohol level of .18, told police that he had two beers at a friend’s house, Gool said.

Also known as Tovar-Martinez, Martinez-Tovar was deported in 2001, Gool said. His criminal background includes a 2008 DUI conviction for which he received 24 months’ probation, A 2009 conviction for DUI earned him a two-year sentence in prison, Gool said.

If convicted, Martinez-Tovar could face one to three years in prison. Probation is also an option. He next appears in court June 19.
