5 years for St. Charles health club car thefts

A 36-year-old former West Chicago resident was sentenced to five years in prison Thursday for a spate of car burglaries outside a St. Charles health club in spring 2010.

Daniel M. Kellogg, of the 400 block of South 10th Court, St. Charles, will begin serving his sentence Aug. 11.

He is eligible to have his sentenced halved for good behavior, and will receive 203 days credit for time spent in jail while his case was pending. He also must pay $473 in restitution to two victims.

Kellogg pleaded guilty in April to three counts of burglary to motor vehicle, a felony punishable by three to seven years in prison.

Kane County Judge Timothy Sheldon accepted the plea agreement, which attorneys hashed out after Kellogg was ruled ineligible for a drug-treatment program called Treatment Alternatives for Safe Communities because of a prior burglary offense.

Assistant State’s Attorney Reagan McGuire said Kellogg would swipe the keys to vehicles from a basket at the front desk of XSport Fitness, 238 N. Randall Road, St. Charles. Members would put their keys and membership cards in the basket while they worked out, she said.

Defense attorney Richard Irvin said his client suffers from bipolar disorder and mild schizophrenia, and stole from vehicles to so he could afford alcohol, marijuana and cocaine.

“He’s been self medicating using drugs and alcohol,” Irwin said.

Kellogg has a criminal history dating back to 1995 when he was charged with writing a bad check in St. Charles, court record show. He also has convictions for burglary, misuse of credit cards and theft.

Kellogg was arrested in April 2010 after authorities found a credit card reader, credit card receipts and a stolen South Barrington police badge during a search of his apartment on the 500 block of Carriage Drive in West Chicago, police said.
