Court dismisses suit against Naperville golfer

Naperville businessman and golfer Ray Kinney is not financially liable for damages caused by a golf shot of his that may have hit a West Chicago woman in the head, a DuPage County Circuit Court judge ruled Friday.

A lawsuit filed by Lillian Demo was dismissed Friday.

The suit stemmed from a 2005 incident near St. Andrews Golf and Country Club in West Chicago. Kinney said Saturday he remembers hitting an errant shot and yelling “fore,” but never hearing the ball land.

He said a man confronted his group, saying a ball hit and injured his wife, but it was never proven that ball was Kinney’s errant shot.

Kinney, 46, said Friday’s dismissal proves he was not negligent and Demo assumed a risk of injury when she decided to live so close to a golf course. A golfer since age 6 or 7, Kinney said he has never returned to the course at St. Andrews.

Demo could not be reached Saturday for comment.
