Cary man charged with assaulting minor

A 21-year-old Cary man is still in jail after being arrested Wednesday and charged with criminal sexual assault of a minor.

John D. Fennessy, of the 400 block of North First Street, was arrested at his home and charged in relation to an assault that took place Jan. 30 in Cary, according to a news release from the Cary Police Department.

According to police, Fennessy sexually assaulted a 17-year-old acquaintance and there was no dating relationship between the two. The alleged assault took place in an unspecified location.

Cary Police Deputy Chief Ed Fetzer would not explain exactly why Fennessy was arrested 12 days from when the assault was reported to police on Feb. 4. “I can’t get into what the investigation entailed, but we can’t just take a statement from a victim and arrest somebody,” he said.

Fetzer said that the charge is a Class I felony because of the use of force.

Bail was set at $50,000, and Fennessy was unable to post the required 10 percent bond amount of $5,000. He is due in McHenry County Court at 9 a.m. on Feb. 21.
