Wheaton man charged with pointing shotgun at neighbor

A Wheaton man is accused of pointing a shotgun at a neighbor who confronted him about a loud party, prosecutors said.

Michael J. Burk, 34, was charged with aggravated assault and reckless conduct early Monday after police responded to his apartment building on the 300 block of Western Avenue.

Assistant DuPage County State’s Attorney Thomas Vega said one of Burk’s neighbors called police to report a loud party earlier Sunday, but the situation was quiet when officers arrived.

Around 1:30 a.m. Monday, after the party grew loud again, the neighbor knocked on Burk’s door, Vega said, and was greeted by the defendant wielding a shotgun.

Vega said the neighbor managed to wrest away the gun, then took it home and called police, leading to Burk’s arrest.

Burk denied the allegations at a bond hearing Monday, where bail was set at $15,000.

“I was assaulted in my apartment,” he told Judge Michael Wolfe.

Wolfe ordered Burk to surrender any weapons and ammunition to Wheaton police and to avoid contact with the neighbor should he bond out while the case is pending.
