Addison man gets 28 years for gang shooting

An Addison man was sentenced Monday to 28 years in prison for a gang-related shooting last year that injured two men.

Michael Bogmenko, 30, was convicted by a DuPage County jury in September of aggravated battery with a firearm and related offenses. He had faced up to 75 years in prison.

Prosecutors said Bogmenko approached three unarmed men about 4 a.m. Aug. 8, 2009, pulled out a handgun and fired six times. The shooting near Green Oaks Court in Addison left one victim with a bullet wound to the abdomen; another was struck in the shoulder.

A police officer who happened to be in the area and heard gunshots located the wounded men and called for paramedics. Bogmenko was taken into custody a few hours later.

“The fact that someone didn't get killed was simply a matter of luck,” Circuit Judge John Kinsella told the defendant at sentencing Monday.

Kinsella said a 28-year sentence was necessary to protect the public and deter “mindless, senseless” gang violence.

Bogmenko received credit toward his prison term for 500 days in the county jail. By law, he must serve at least 85 percent, or about 24 years.
