Suspect in Elgin assault skips court
An arrest warrant has been issued for Octavio Nunez, a Crystal Lake man accused of assaulting a woman in Elgin in August after he claimed he needed a ride, police said
Nunez, 36, of the 900 block of Darrington Street, missed a court date Monday in Kane County and forfeited $9,000 he had posted as bond.
It was the second time Nunez, who faces up to five years in prison if convicted of the Aug. 29 attack, missed court.
He also did not appear at a hearing in October, court records show.
Prosecutors have sought to increase Nunez's bond after Elgin police charged him in Sept. 16 with failing to register as a child sex offender within five days from his release from jail, records show.
In the case from August, Nunez is accused of assaulting a woman, whom police have described as being a “Good Samaritan,” who picked him up after he said he needed a ride to the 400 block of Airport Road where he had a hotel room.
Nunez faces charges of aggravated criminal sexual abuse, unlawful restraint and failure to register as a sex offender. He is accused of forcing himself on the woman while the two were in her vehicle.
The victim, an Elgin woman in her 30s, called 911 and left the line open before the attack occurred and then drove him to the Grand Victoria Casino in Elgin, where he later was arrested.
