No charges in fatal Wauconda accident
A 60-year-old Woodstock man who struck and killed a pedestrian will not be charged with a crime, Wauconda Police officials said Monday.
Police Chief Doug Larsson said Pedro Gomez, 42, of Round Lake Park was killed when he was struck by a 1991 Honda Accord while walking in the roadway at Route 176 and Foster Road early Sunday morning.
Gomez was wearing dark clothing, Larsson said, and the driver did not see him until it was too late to avoid hitting him.
“There is no indication any traffic laws were violated,” Larsson said. “Investigators feel the driver could not have seen the pedestrian until last moment because the victim was wearing very dark clothing. It's just an unfortunate accident.”
Police officers and rescue crews were called to the scene of the crash and saw Gomez unconscious on the roadway just after 4 a.m., Larsson said.
Gomez was pronounced dead at the scene by the Lake County Coroner's office.
The Wauconda Police Department and the Lake County Major Crash Assistance Team investigated the crash.
