Addison man guilty in shooting, faces 75-year sentence

A DuPage County jury convicted a 29-year-old Addison man of aggravated battery with a firearm in connection with a shooting last year that injured two people.

In addition to the more serious charge, prosecutors Steve Knight and David Bayer also secured convictions of aggravated discharge of a firearm, illegal possession of a firearm by a convicted felon and unlawful use of a weapon against Michael Bogmenko. The jury acquitted Bogmenko of attempted murder charges.

Bogmenko's trial lasted five days. The jury deliberated about nine hours before coming to its decision. Bogmenko faces up to 75 years in prison for the early morning Aug. 8, 2009, shooting near Green Oaks Court in Addison.

Prosecutors said Bogmenko approached three unarmed men about 4 a.m. the day of the shooting, pulled out a handgun and fired six times at the men. Two of the men were hit - one in the shoulder, the other in the abdomen.

A police officer who happened to be in the area and heard the gunshots encountered the wounded men and called for paramedics. The two victims were transported to a nearby hospital where they were treated for their injuries. Prosecutors said the two have since recovered from their injuries.

"Michael Bogmenko, without provocation, attacked three unarmed men, sending two of the men to the hospital with serious gunshot wounds," said DuPage State's Attorney Joe Birkett. "The jury's guilty verdict demonstrates that this type of behavior will not be tolerated in our society."

Police nabbed Bogmenko a few hours later and he was taken into custody without incident. He has been held at the DuPage County jail in Wheaton without bond since his arrest. Bogmenko is due in court again Oct. 6 to set a sentencing date.
