Aspiring Marine accused of taking nude photos of teen girlfriend

A Carpentersville man and aspiring Marine faces charges of criminal sexual abuse and possession of child pornography, police say, after he had sex with, impregnated and took lewd photos of a 16-year-old girl.

Jody B. Garcia, 18, of the 0-100 block of Sycamore Avenue, was charged Wednesday.

"If the girl was a year older, it wouldn't even be a crime," Carpentersville Police Cmdr. Timothy Bosshart said. Garcia and the Carpentersville girl had been dating for 11 months, Bosshart said, but the girl's mother was unaware of their relationship.

On Wednesday, he said, the mother found out about the relationship and that her daughter is four months pregnant with Garcia's child. She called police at 8:45 p.m., and officers arrested Garcia there, seizing several nude photos of the girl, police said.

On Thursday morning, Kane County Judge Bruce W. Lester set Garcia's bond at $50,000.

But Garcia asked for a "lighter sentence," as he has dreams of joining the Marines.

"I really don't want to jeopardize that," he said.

Lester replied that Garcia should be more concerned with the charge keeping him out of the Marines, not the bond itself.

"The bottom line is that now you're facing a Class 3 felony," Lester said.

Class 3 felonies come with a sentence range of two to five years in prison.

Garcia said he couldn't post the $5,000 he needed to secure his release while the case is pending.

His next court date is May 7 at the Kane County Judicial Center.
