$500,000 bond in Wood Dale gun attack
A Wood Dale man's bond was increased Friday to $500,000 after he was accused of putting a gun to a relative's head during a dispute.
Payton Osborne, 33, was indicted this week on aggravated unlawful restraint, aggravated battery and a new charge of armed violence, which carries a minimum 15-year prison term.
Prosecutors said Osborne became violent March 19 in his home on the 300 block of Elmhurst Street and began to punch, kick and push the family member. He later threatened the victim with a loaded handgun, according to court records.
"The defendant took the magazine out of the gun to show the victim that it was loaded with bullets, put the magazine back in the gun, and racked it to put a bullet in the chamber," Prosecutor Enza LaMonica wrote in court records seeking the bond increase. "The defendant placed the handgun against the victim's face and head and threatened to kill her."
Osborne later confessed and led police to the gun, prosecutors said. He was arrested and ordered held on a $100,000 bond.
In seeking a lower bond, defense attorney Steve Olczyk cited Osborne's clean criminal record, employment and community ties. But LaMonica urged DuPage Circuit Judge Daniel Guerin to increase bond for Osborne, who he said "poses a real and present danger" to his family and the public.
The judge agreed. Osborne must post the required 10 percent of the $500,000 bond to be set free. He remained at the DuPage County jail late Friday.
