Third suit filed blaming Crystal Lake man for fatal crash

The parents of a Huntley man killed along with three friends in a 2007 one-car crash filed suit Friday claiming the vehicle's driver was high on marijuana, had alcohol in his system and going too fast when the wreck occurred.

Francisca Noule and Ike Augustine Onwualu are seeking more than $50,000 in damages through the wrongful death lawsuit filed against 26-year-old Crystal Lake resident Fakir M. Jaffrie.

The suit, filed in McHenry County Circuit Court, also lists Jaffrie's parents as defendants, alleging that the car their son was driving belonged to them and they were therefore liable for how he used it.

Oseloka Henry Onwualu, 19, was a passenger in Jaffrie's car in the early morning hours of Sept. 8, 2007 when it veered off Dietrich Road between Brier Hill Road and Route 20, west of Huntley. The car, police said, struck a tree stump and then slammed into a tree.

Onwualu initially survived the wreck and underwent multiple surgeries before succumbing to his injuries Sept. 14, 2007, according to the lawsuit.

"Oseloka Henry Onwualu experienced extreme pain and suffering prior to his death as a result of the injuries incurred in the accident," the suit states.

Also killed in the crash were brothers Kumail Husain, 20, and Zohair Husain, 18, of Algonquin, and Ayush Joshi, 20, of Hoffman Estates.

Jaffrie is awaiting trial in Kane County on aggravated driving under the influence and reckless homicide charges alleging he was under the influence of marijuana when the crash occurred.

The lawsuit is the third filed against him since the crash. Last week, estates for the Husain brothers sued in McHenry County, seeking more than $50,00 apiece in damages.

In November, Joshi's father sued in Kane County, citing Jaffrie's negligence as the cause of his son's death and also seeking more than $50,000.
