Police looking for enough evidence to charge in fatal ATV crash
The McHenry County Sheriff's Office is asking that anyone who saw a fatal all-terrain vehicle crash near Cary last month step forward.
Police say they do not have enough information to request charges in the crash that killed 28-year-old Scott Hull and injured the vehicle's owner, James W. Kalal, 26, both of Cary.
On Aug. 16 just after 3 a.m., the pair were riding Kalal's ATV on Spring Beach Road, when it left the street and smashed into a tree on Ebert Drive.
Sgt. Karen Groves said both men had been drinking and that the blood alcohol content of both men was more than twice the legal limit.
But police do not have enough evidence to know which man was actually driving, Groves said.
That's because Kalal has told police he has no memory of the collision, and because the crash occurred so early in the morning that nobody saw it right when it happened, Groves said.
Finally, there is not enough physical proof - fingerprints and the like - to say which of the two Cary men was at the controls, she said.
"Based on all that, that's not helping us determine who was driving," Groves said.
