Judge orders witness in Addison murder case to stick around

A DuPage County judge issued a rarely used material witness bond in an effort to keep a 16-year-old girl from fleeing the country.

Prosecutors want the Addison girl to testify against her boyfriend, who is accused of shooting a rival to death last month.

Judge Peter Dockery set the bond at $10,000. It requires the teenager to appear in court when called upon or risk being assessed with a $10,000 fine. Because she is a minor, her father also would be on the hook for the bond amount if she runs, a spokesman for DuPage County State's Attorney Joseph Birkett said. The girl has to seek permission from the court to leave the state.

Prosecutors said the girl will provide testimony that indicates 19-year-old Chicago resident Luis Villavicencio-Serna killed 18-year-old Armando Huerta Jr. May 16 outside the victim's apartment complex in Addison.

Investigators linked the girl to the case after discovering text messages from her to Huerta warning him to stop calling her because it was making her boyfriend angry.

Prosecutors have three other witnesses who told investigators they were with Villavicencio-Serna when he shot Huerta.

Villavicencio-Serna is being held in lieu of a $5 million bond at the DuPage County jail in Wheaton. Prosecutors sought the high bond amount because they consider him a flight risk because he was in the country illegally and still has family in Mexico.
