Drunken driver should be deported

Mateo Ortiz, who is in the country illegally, hit someone while driving drunk. Judge Thomas Fecarotta sentenced Ortiz (who already has four drunken driving cases pending) to five years in prison. My questions are, why don't we deport him back to Mexico? We have to spend our tax dollars to feed and clothe him in prison for what reason?
