Aurora man pleads guilty shooting gun are rival gang member
The last of three brothers accused of trying to murder a member of a rival gang in Aurora pleaded guilty Friday to aggravated battery - discharge of a firearm.
Francisco D. Perez, 26, will be sentenced Monday to 20 years in prison.
Kane County Assistant State's Attorney Bill Engerman told Judge John Barsanti that on Nov. 29, 2020, Perez saw the victim drive past his house and that a passenger in the car showed something shiny. Perez and his brothers then went looking for the victim and found him in the 800 block of Claim Street. The brothers then fired at least 49 shots at the car in which the victim was sitting, hitting him four times.
Afterward, the brothers returned to their home in the 200 block of Ohio Street, hid their vehicle and went into the house, Engerman said. There was a three-hour standoff with police before they surrendered.
Charges of attempted murder and armed violence were dropped in exchange for the plea.
Perez will have to serve at least 85% of his sentence before being eligible for parole. He is receiving credit for the 652 days he has been held in the Kane County jail awaiting trial.
Christian Capuchino, 17, pleaded guilty in June to aggravated battery with a firearm and agreed to a 12-year prison sentence.
Ismael Perez, 22, pleaded guilty Aug. 25 to aggravated battery - discharge of a firearm and agreed to a 20-year prison sentence.
