Elgin police: Man caught with 3.5 pounds of THC edibles, hatchet

A 39-year-old man faces prison after an arrest Monday in Elgin when police say he was caught with more than 3½ pounds of THC edibles, crack cocaine, a scale and a hatchet.

Kevin M. Colley, who told police he is homeless but has an Elgin address on the 300 block of Washburn Street, is charged with three counts of felony armed violence, manufacture/delivery of 500 to 2,000 grams of cannabis, possession of 500 to 2,000 grams of cannabis, possession of a controlled substance, possession of drug paraphernalia and driving while license suspended/fourth to ninth offense, according to an Elgin police report and Kane County court records.

Colley was arrested after police saw him driving in a 2005 Honda Odyssey minivan about 11:13 p.m. Monday on the 200 block of Gifford Place, according to a police report.

An officer saw Colley park, and approached the minivan. Colley opened the passenger side sliding door and the officer smelled a strong odor of fresh cannabis, according to the report.

Colley admitted he had marijuana, and police found a small crack rock, two joints, a grinder and a scale in the minivan, according to the report.

Officers also found a large plastic bag with 22 packages of edibles inside, each in packaging indicating the presence of THC, the report said.

The total weight of the edibles, according to the report, was 1,664.9 grams, which is nearly 3.7 pounds.

At the police station, Colley denied the drugs were his and said the hatchet was used to chop ribs, the report said.

If convicted of the most severe charge of armed violence, Colley faces a sentence ranging from six to 30 years in prison with no chance of probation.

Colley is next due in court May 6. His bail information was not immediately available.

At the time of his arrest, Colley was free on bond for two pending driving while license suspended cases from January and March 2019, court records show. Each of those felony charges carries a sentence ranging from probation to three years in prison.
