Aurora man accused of kidnapping, beating ex-girlfriend sent to prison

An Aurora man accused of kidnapping and beating a West Dundee woman in 2018 was sentenced to 30 months in prison after pleading guilty to an amended charge of aggravated battery.

Javier Gaston Nunez-Garcia, 22, of the 1100 block of Ridgeway Avenue, faced up to 30 years in prison on the original charges of three counts of kidnapping, two counts of domestic battery, along with felony unlawful restraint, aggravated battery in a public place and violation of an order of protection stemming from an attack Feb. 1, 2018, according to Kane County court records.

Wednesday, Nunez-Garcia pleaded guilty to an amended count of felony aggravated battery/strangulation in exchange for prosecutors' dismissing other charges.

Kane County Judge John Barsanti accepted the plea. An order of protection for the victim, 21-year-old West Dundee woman, also was extended to be in effect for two years after Nunez-Garcia is released from prison and his parole ends.

According to court records, Nunez-Garcia and the victim dated up to four years. He was accused of choking, biting, scratching, spitting on her, pulling her hair, slamming her head into the car door and taking away her phone. Nunez-Garcia also was accused of abducting the woman from a parking lot and taking her to a residence in West Dundee, where she was held captive until she was able to escape.

Nunez-Garcia has two pending cases in McHenry County and is next due in court for those May 22.

He faces four counts of felony aggravated battery on charges he punched a man in the face and broke his nose during a dispute with his former girlfriend in June 2017. Nunez-Garcia also was charged in November 2017 with selling drugs near a park or school in McHenry County, records show.

He faces six to 30 years in prison on the aggravated battery case and four to 15 years in prison on the drug case, records show.

Brittany Pedersen, who is Nunez-Garcia's defense attorney, did not return messages.
