Lawsuit: Batavia saddlery store sale was based on misleading information

A Hinckley woman wants a judge to void the sale of former Batavia business Oros Saddlery arguing she was intentionally deceived by the former owners about its operating expenses and client base.

In her lawsuit, attorney Krista Carls MacLean argues George "Buzz" Oros and his wife, Dori, presented false and misleading information about the sale of Oros Saddlery to MacLean to be operated under the name of Bits n' Spurs Inc.

The suit wants a judge to rescind the contract between the two sides and "restore each party" to their respective positions before the Oct. 20, 2016, sale.

Bits n' Spurs, at 1931 W. Wilson St., is now out of business. A copy of the sale contract was not included in the court record.

Efforts to reach the Oroses were not successful; MacLean did not return a message seeking comment.

The suit argues Dori Oros gave false information that it would cost $35,000 to $40,000 to replenish the store's inventory to levels before a closing sale occurred and that the store would generate annual income of $465,000.

The lawsuit contends that Oros presented a list of 1,200 customer email addresses but failed to note that only 20 percent of store email blasts were actually opened.

"Based upon the representations as to the income that the business generated and the manner in which the business generated income, the parties negotiated a buyout believing that the business would continue to generate the same or substantially the same amount of income," read part of the complaint. "The business failed to generate the same or substantially the same income as represented by defendants."

No criminal charges have been filed against George or Dori Oros with regard to the case.

The two sides are due in court Jan. 3.
