State's attorney considering charges in killing of dog by Wayne village president's husband
Kane County sheriff's detectives have finished their investigation into the shooting death of a dog by the husband of Wayne's village president, and they have turned their findings over to Kane County State's Attorney Jamie Mosser to review.
Mosser and her staff will determine whether to file criminal charges against Hal Phipps, the husband of Village President Eileen Phipps.
"We will review all of the evidence from the thorough investigation performed by the Kane County sheriff's office. Based on the applicable law, we will make a determination as to whether charges are appropriate. I know people are interested in this case, but in the interest of justice we must be thorough," Mosser said in a news release Thursday.
Phipps shot the dog, Ludwig, on Aug. 10 in Wayne. He told authorities that Ludwig and another dog were aggressively blocking him on a path from his boat launch on the Fox River to his house. He said the dog had previously bit him.
The dog's owner says the dogs were not on the Phipps' property but were playing in the river near his launch. The dogs were accompanied by a friend of his.
Sheriff's deputies were first to arrive at the scene because they were closest. Wayne police asked the sheriff to take over the investigation due to it involving the village president's husband.
