East Dundee woman sues Elgin store over moldy mattress, box spring

An East Dundee woman is suing an Elgin mattress store, alleging she was hospitalized after buying and sleeping on a mattress and box spring infested with toxic mold.

Marva Cannaday seeks unspecified damages of more than $50,000 from MattressFirm, 2415 Bowes Road, in the lawsuit filed in Kane County.

The suit states that the 59-year-old Cannaday bought a Hartfield Luxury firm mattress and a Beautyrest box spring on Aug. 14, 2016. She noticed an odor coming from it after it was delivered to her home, according to the suit.

"Due to trouble sleeping after purchasing and sleeping on the mattress, (Cannaday) sought treatment at the Pulmonary Sleep Clinic on April 13, 2017," the lawsuit reads.

Cannaday later was taken to Advocate Sherman Hospital in Elgin with shortness of breath, coughing, wheezing and other symptoms, according to the suit. She was diagnosed with bronchospasms, acute bronchitis and other conditions "induced by mold on her lungs that doctors linked to her new mattress," according to the suit.

The mattress and box spring were sent to a company for testing and both contained "hazardous airborne mold pollutants and active mold growth," the lawsuit states.

Cannaday is seeking damages for her injuries, arguing negligence and breach of implied warranty because she was not informed of the mold growth. Her attorney, James Fabbrini, could not be reached for additional comment.

A message left at MattressFirm was not returned.

The two sides are due in court Oct. 30.
