Geneva woman charged with poisoning husband makes court appearance

A Geneva woman accused of a fatally poisoning her husband Jan. 26 returned to court Thursday in Kane County, where prosecutors exchanged information with defense attorneys, and the case was continued to March 9, according to prosecutors and court records.

Julia Gutierrez, 53, faces between 20 and 60 years in prison if convicted of first-degree murder in the death of her husband, Eduardo, also 53, Jan. 26 at their home on Crissey Avenue.

Prosecutors argue Gutierrez poisoned her husband's shake with temazepam. Prosecutors also said Gutierrez tried to poison her husband in 2002, though she was not charged. She is being held without bail at the Kane County jail.

Eduardo Gutierrez's homicide is the second in Geneva since July 2014 and the third since 1975.
