Bond lowered for ex-Waukegan cop charged with rape

The bond for a former Waukegan police officer charged with raping a woman in his squad car was cut in half Friday.

Even though Delatwan Haynes' bond was reduced from $2 million to $1 million, he is likely to remain jailed, as his attorney said Haynes' family can raise only a tenth of the cash he would need to post.

Haynes, 32, is charged with aggravated criminal sexual assault, aggravated kidnapping, aggravated criminal sexual abuse and official misconduct.

Lake County Assistant State's Attorney Patricia Fix said Haynes, who was a police officer for seven years before his resignation shortly after the incident, was on patrol during the early morning hours of Jan. 6 when he stopped the woman for jaywalking in downtown Waukegan, searched her and found a crack pipe.

Haynes gave the woman the crack pipe and told her to go home, Fix said, but encountered her again a few blocks away and ordered her into his squad car.

Fix said Haynes drove the woman to a parking lot behind a truck rental lot, had sex with her, threw a condom out of the car and drove the woman home.

The woman called Waukegan police to report what happened and returned to the lot to retrieve the condom, which Fix said has tested positive for her DNA and Haynes'.

In a response to a civil suit the woman filed against the city, attorneys for Waukegan concede the sex act took place, but claim it was consensual.

Defense attorney Jed Stone acknowledged the charges against Haynes are serious, but called a $2 million bond "Constitutionally oppressive."

Fix asked Circuit Judge Victoria Rossetti to leave the bond as it was, saying it was appropriate for a public officer charged with serious offensives.

Rossetti cut the bond in half, which would require Haynes to post $100,000 to get out of jail.

Stone said Haynes' family told him they believed they could raise $10,000 for bond.

Haynes faces up to 30 years in prison if convicted, and is scheduled to go to trial Sept. 22.
