Driver's ed fees can continue, judge rules
A Cook County Circuit Court Judge Tuesday denied Buffalo Grove atheist Rob Sherman's request for a temporary restraining order to prevent Buffalo Grove High School from charging $350 in fees for its driver's education class.
Sherman's daughter, Dawn, is a student at the school, and her father sued the high school and Northwest Suburban High School District 214, arguing the fees are unconstitutional. He had sought an order which would have prohibited the school from charging the fees until further hearings could be held on whether they are, in fact, unconstitutional. Sherman is representing himself in the suit.
His request was denied Tuesday by Chancery Court Judge Peter Flynn, according to a court docket. However, the underlying question has not yet been resolved, and the case continues. The next court date is March 11, 2009.
