East Dundee man faces prison for sex assault on sleeping girl
A former East Dundee man was convicted of sexually assaulting a sleeping girl more than four years ago.
Josh L. Westmorland, 21, formerly of the 100 block of Barrington Avenue in East Dundee, was convicted on Friday of one count of criminal sexual assault and one count of sexual exploitation of a child in a 2005 incident. Westmorland waived his right to a jury trial.
According to the Kane County state's attorney's office, Westmorland, then 17, sexually assaulted a 16-year-old girl who was sleeping and unable to give consent on March 4 and 5, 2005. Westmorland later performed a sex act in front of a minor girl, according to the state's attorney's office.
Westmorland will be sentenced on April 2. He remains free on a recognizance bond but faces between four and 15 years in prison.
When he is released, Westmorland must register for life as a convicted sex offender.
"The victims deserve the credit for this conviction," said Assistant State's Attorney Christine Bayer.
"Without their perseverance, the defendant might well have been acquitted. We also need to thank the Carpentersville Police Department and the Kane County Child Advocacy Center for their thorough and persistent work with this case," Bayer said.
