Kane County sued over pothole

Talk about a nasty pothole.

An Aurora woman is suing Kane County over a particularly pesky one that she blames for a four-vehicle crash that left her severely injured a year ago.

On Jan. 22, 2008, Lina Santiago was driving south on the 1400 block of South Kirk Road in Batavia when a pothole caused her to lose control and crash into three other vehicles, according to a lawsuit filed Wednesday in Kane County Circuit Court.

Santiago is suing for more than $50,000, claiming the county was negligent by failing to repair the pothole, put up a barricade around it or post a warning to motorists.

As a result of the crash, Santiago "suffered severe and permanent injuries," including contusions to her "neck, back, spine, arms, legs, body, head and the bones, joints, muscles, tendons, nerves, membranes, ligaments and vessels thereof," the suit says.

Special Assistant State's Attorney Ken Shepro, who represents the county, said, "We haven't seen the lawsuit and therefore can't comment on it."
