Three arrested in Carpentersville fight
An early morning Halloween brawl in Carpentersville involving a baseball bat sent one man to the hospital and three others to jail, police said.
Marcos Hernandez, 37, of the 100 block of Pecos Circle, Carpentersville, was charged Sunday with aggravated battery and mob action — police say he is the one who beat the 21-year-old victim with a baseball bat.
Jacob R. Bennett, 19, of the 900 block of Berkley Street, and Brian A. Gavina, 18, of the 600 block of Jefferson Avenue, both in Carpentersville, were each charged with mob action, a Class 4 felony.
During a Monday morning bond hearing, Bennett and Gavina each said they previously belonged to a gang.
Police say that at around 4:15 a.m., a group of five, including the three suspects, got into an argument with the victim in the 100 block of Caddy Avenue.
The group then chased him around the front yard and once someone tackled the victim Hernandez hit him four times with the bat while the victim was still down, Kane County Judge Bruce Lester said, reading from a police synopsis.
Police don't know what they were arguing about or whether the incident was gang related.
The victim was treated at Sherman Hospital in Elgin, police Cmdr. Erman Blevins said. His condition was not available Monday.
Lester set Hernandez's bail at $75,000, Gavina's at $55,000 and Bennett's at $40,000.
All three men are scheduled to appear in court Nov. 12 at the Kane County Judicial Center.
Aggravated battery is a Class 3 felony that carries a prison sentence of up to five years.
If found guilty of mob action, Bennett and Gavina could spend between one and three years behind bars.
