No charges over births in S. Ind. motel toilet

CLARKSVILLE, Ind. — Prosecutors in southern Indiana have decided they won’t file criminal charges against a woman whose son died after being born with in a motel toilet with a twin sister.

Clark County’s chief deputy prosecutor says the 36-year-old woman’s low mental ability makes it impossible to prove she had criminal intent when she gave birth July 22 at a Clarksville motel.

Jeremy Mull tells The Courier-Journal that evidence backs the claims of Betsy Dalton and her 52-year-old boyfriend Jerry Conrad that they didn’t know she was pregnant.

Conrad called for help when Dalton gave birth and officers found the newborn girl atop her brother in the toilet. Authorities say the boy couldn’t be revived, but the girl survived and was placed into the custody of Child Protective Services.
