Man faces gun, battery, armed habitual criminal charges in Elgin

A 28-year-old Carpentersville man is being held on charges that he pointed a gun at someone in Elgin.

Jose Acosta Jr., of the 7000 block of Lowell Drive, was arrested early Sunday morning. He is charged with being an armed habitual criminal, possession of a firearm by a street gang member on land, being a felon possessing or using a weapon while on parole, aggravated unlawful use of a weapon in public - previous felony conviction, possession of a firearm without a firearm owners identification card, and three counts of aggravated unlawful use of a weapon.

Elgin police responded around 3:06 a.m. Sunday to the 300 block of Douglas Avenue for a report of a person with a gun. The victim told police the man was walking a dog and pointed the gun at him.

Police spotted a person who matched the description provided by the victim. The man ran away and discarded a gun, according to police.

Acosta Jr. was apprehended a short time later. The gun also was recovered by police.

Acosta Jr. is being held on $200,000 bail at the Kane County jail. He would need to post $20,000 bond to be released before trial.

State prison records indicate he was paroled in October 2021 on a Kane County conviction for possession of cocaine.
