Probation for Elgin man who drugged, fondled caretaker

An Elgin man was sentenced to three years probation and intensive sex offender treatment after admitting to slipping sleeping pills into his 25-year-old caretaker’s drink and fondling her.

Raymond Kvacik, 76, of the 100 block of South State Street, had been in jail since his arrest in February after his caretaker reported the attack and Elgin police had a female officer pose as his new caretaker.

He faced up to seven years in prison for felony criminal sexual abuse charges, but probation also was an option.

Assistant State’s Attorney Pam Monaco said Kvacik put crushed Ambien into his caretaker’s grape juice on Feb. 14, molested her after she passed out, and later confessed to police after his arrest.

“She drinks (the grape juice) to be polite and starts to feel weird pretty quickly,” Monaco said, noting the caretaker woke up to find Kvacik fondling her.

The woman reported the attack to her supervisor, who later notified police.

As part of the plea agreement, Kvacik must register as a sex offender, live with his stepson in Pingree Grove and attend intensive sex offender treatment.

The agreement also called for 180 days in the county jail with the opportunity to have the sentenced halved for good behavior.

Kvacik, who appeared in court in a wheelchair and only spoke to admit his guilt, had already spent 108 days behind bars and was released to his stepson.

“This (sentence) just mirrors the recommendations in the sex offender eval(uation),” Monaco said. “It was a treatment-based recommendation.”

On Thursday morning a report deemed Kvacik fit for trial, thus prompting a guilty plea to aggravated criminal sexual abuse and unlawful delivery of a controlled substance,

Judge Timothy Sheldon noted that two psychologists at the Kane County Diagnostic Center had interviewed Kvacik and found him to be depressed but not suffering from hallucinations or delusions.

“They found that Mr. Kvacik’s thought processes were clear, logical and goal oriented,” Sheldon said.

Monaco acknowledged that Kvacik did not have an arrest record, but suggested the February attack was not the first.

She noted that police searched Kvacik’s room at a nursing home in the 1300 block of Fleetwood Drive in Elgin in August 2009.

They found 122 tablets of Zolpidem, a generic form of Ambien, in his room when his prescription was only good for 30 pills at a time.

According to court documents, police also recovered five pornographic DVDs, male enhancement pills, two cameras, a sex toy and a pill cutter. No charges were ever filed.
