St. Charles man charged with DUI, endangering child’s life

A 32-year-old St. Charles man is facing 10 charges including aggravated driving under the influence and endangering the life of his 4-year-old daughter after a Sunday night crash.

Jair Martinez was driving his 2003 Mitsubishi Eclipse with his daughter inside when he turned in front of an oncoming SUV at the intersection of Randall Road and Prairie Street Sunday night, according to police.

His daughter was not in a car seat, contrary to earlier reports, and she was seriously injured in the crash, said St. Charles Police spokesman Paul McCurtain.

Both passengers in the SUV, a 65-year-old St. Charles man and his 58-year-old wife were also injured in the crash and were treated at Delnor Hospital for minor injuries, police said.

Martinez, who has a history of driving without a license, did not have a valid license or insurance when he crashed at about 8 p.m., according to police.

The 4-year-old was originally taken to Delnor Hospital with serious injuries and was transferred to Loyola Medical Center in Maywood for advanced treatment, officials said.

Martinez was also injured in the crash and was taken to Delnor Hospital, said St. Charles Assistant Fire Chief Joel Schelstreet.

Upon his release, Martinez was charged with four counts of aggravated driving under the influence, driving under the influence of alcohol, endangering the life of a child and improper child restraint for a child under 8. He is also charged with driving with a license that had been expired for more than a year, operating an uninsured vehicle and making an improper left turn, according to court records.

Martinez remained at the Kane County jail in lieu of $20,000 bail as of Wednesday.

Since late 2009, Martinez has been cited for driving without a license twice.

On Dec. 22, 2009, he was stopped in St. Charles and cited for driving without a license and driving an uninsured vehicle and in Geneva on Jan. 1, 2010, he was cited for driving having never been issued a license, according to court records.
