Elgin Recycling sues Google over security codes

Elgin Recycling has filed suit against Google for release of its e-mail security codes and passwords after an ex-employee absconded with them.

According to the suit filed in Cook County Circuit Court Friday, the firm's Gmail account was administered by an employee and opened in April 2009, but the employee "terminated his employment" on May 25 and "retained all security codes and passwords."

The suit said the firm made numerous attempts to inform Google of the "surreptitious use of the account" and that "its former employee was using (the) e-mail account," and demanded release of the security codes and passwords, but "defendants have failed and refused to comply with this request."

The suit claims breach of contract and violation of the Illinois Consumer Fraud Act and asks control of the account be returned to the firm with all messages filed in the interim. It seeks damages in excess of $50,000.

Google did not reply to requests for comment. Elgin Recycling is located at 660 Schiller St.
