Elgin rapist gets 12 years
An Elgin man was sentenced to 12 years in prison Thursday for a 2009 sexual assault.
Victor Vargas, 48, of the first block of Times Square, was convicted in July of three counts of criminal sexual assault and will consecutively serve four years for each count, according to the Kane County state's attorney's office.
On Feb. 25, 2009, the victim woke up in a bedroom in Vargas's home to find Vargas sexually assaulting her.
Vargas and a friend met up with the victim, described as an acquaintance of Vargas's friend, at a tavern the night before. When the woman became sick, the men offered to drive the woman home, but the woman became sick a second time and Vargas drove the group to his home. The woman fell asleep in a bedroom in Vargas's house, and after Vargas's friend left for work, she awoke to the assault, according to the state's attorney's office.
In addition to the 12-year sentence, Vargas must register for life as a convicted sex offender and faces deportation upon his release from prison. He must serve at least 85 percent of the sentence but has been given credit for 576 days already served in the Kane County jail.
