Carpentersville man faces fourth DUI charge
A 35-year-old Carpentersville man this week was arrested on charges of his fourth DUI with his two young children in the vehicle, according to police.
Luis M. Villa-Silva, of the 700 block of Alma Court, was also charged with driving while his license was revoked, obstructing identification and two counts of child endangerment, according to Kane County court records.
The most serious felony charge, the fourth DUI, is punishable by up to four years in prison, though probation is an option.
Carpentersville Police Cmdr. Timothy Bosshart said authorities received a 9-1-1 call at 4:08 p.m. Tuesday for a possible drunken driver near Racine and Hawthorne roads. When officers arrived, they found Villa-Silva exiting his vehicle and he reeked of alcohol, had problems with his balance and his eyes were glassy and bloodshot, Bosshart said.
“He also had his two small children (ages 2 and 5) with him,” Bosshart said. “The officers investigated. (Villa-Silva) was obviously impaired. He was arrested on charges of DUI. He gave a false name and birth date, initially.”
Information about Villa-Silva’s first two DUI arrests was not immediately available, but according to Kane County court records, he was last arrested Nov. 21, 2012 by Aurora police.
In that incident, Villa-Silva, then of Aurora, was charged with felony DUI, DUI with a blood alcohol concentration of more than .16, driving while his license was revoked, no insurance and open alcohol, records show.
Villa-Silva was being held at the Kane County jail on $303,000 bail. His next court date is Sept. 13.
